This legal notice concisely informs about the main aspects of the digital participation platform COOPMMUNITY (coopmmunity.eu), promoted by the companies CREARQCIÓ COOP. V. + CARPE ESTUDIO COOP. V. + ESTUDI DE DISSENY JOAN ROJESKI COOP. V. . The platform aims to promote citizen participation and direct, deliberative and participatory involvement in processes of promotion, dissemination and promotion of cooperativism, especially housing cooperativism or related aspects through the different processes, spaces and bodies of participation, generating forms of direct and open interaction.
Citizens accessing this platform undertake to accept and comply with all the provisions of this legal notice and all the applicable provisions. They also undertake to make lawful and appropriate use of the contents and services and to refrain from any conduct that is illegal or contrary to good faith.
The coopmmunity.eu platform is owned and managed by the companies CREARQCIÓ COOP. V. + CARPE ESTUDIO COOP. V. + ESTUDI DE DISSENY JOAN ROJESKI COOP. V., hereinafter referred to as the OWNERS OF THE WEBSITE.
A. Scope of application of these terms of use
The terms of use for participation in the coopmmunity.eu platform are binding on all persons participating in this website. At the time of registration you will be asked to accept these conditions.
The WEBSITE OWNERS reserve the right to modify the present conditions for the platform and will publish the latest version of these conditions on this website. To keep informed of future changes, we advise you to visit this page from time to time. Users will be informed of modifications when they affect privacy and/or security.
B. Objective of the initiative
Coopmmunity is a platform that supports the processes of discussion, training, advocacy, promotion, co-design of Housing Cooperatives and related aspects of cooperativism. Housing Cooperatives are central to fostering inclusive and cohesive communities, with an emphasis on community participation in design and management to ensure viability and accessibility.
Our mission is to streamline and democratise the co-design process in housing cooperative communities. This involves creating an understandable and efficient co-design process for architecture and facilitation professionals through a digital tool (coopmmunity.eu) that facilitates interaction and decision-making within and between the group and the professionals.
Through the platform (coopmmunity.eu), the aim is to promote citizen participation in an open and transparent manner and to involve citizens and the different social agents in improving the processes of promoting cooperative housing and related aspects, as well as in the assessment, information, discussion, prioritisation and decision on related issues. In this way, the aim is to tackle the challenges and difficulties that arise in the model of housing cooperatives in transfer of use, with the aim of consolidating it and opening it up to the public as a whole through multiple processes, spaces, bodies and other forms of citizen participation.
C. General aspects of participation in the coopmmunity.eu platform
Any natural person over 18 years of age who has previously registered on the coopmmunity.eu platform can participate. By accepting these terms of use, the registered person declares that he/she is 18 years of age or older. The platform also allows the possibility of opening the registration to entities, collectives, groups and/or citizen organisations and relevant actors of the model.
As the coopmmunity.eu platform is a meeting point that aims to promote citizen participation for the improvement of the city, users are obliged to use it diligently and in accordance with this objective.
The OWNERS OF THE WEBSITE are not responsible for the incorrect use of the coopmmunity.eu platform by users or for the content they provide. Each user is responsible for using the platform correctly, as well as for the legality of the content and opinions shared.
It is not permitted to add any illegal or unauthorised content to the website, such as information that has the following characteristics:
that is false or misleading;
infringes any rights of the WEBSITE OWNERS or any third party, such as copyright, trademarks or other intellectual and industrial property rights or other related rights;
violates the privacy of a third party, such as publishing personal details of participants, such as name, address, telephone number, e-mail address, photographs or any other information of a personal nature;
that contains viruses, Trojan horses, bots or other programs that may damage the website or the system of any third party, or that are intended to circumvent the technical measures designed for the proper functioning of the platform;
that seeks to spam users or overload the system;
having the character of a message chain, pyramid scheme or gambling;
for commercial purposes, such as posting job offers or advertisements;
that does not conform to public decency; accordingly, content must not incite hatred, discriminate, threaten, provoke, or have a sexual, violent, rude or offensive meaning or character;
in breach of an applicable law or regulation;
campaigning to promote mass voting for other proposals unrelated to the process and framework of the debate, and
creating multiple users pretending to be different people (astroturfing).
The OWNERS OF THE WEBSITE cannot be held responsible for the quality, originality, authenticity, legality or security of the content provided by users on the platform. However, the WEBSITE OWNERS reserve the right to remove from the coopmmunity.eu platform any opinions, information, comments, proposals or files that contradict these conditions of use, and may install filters to that effect. This shall be done solely for the purpose of preserving the fundamental objective of the coopmmunity.eu platform. The WEBSITE OWNERS also reserve the right - without prior notice - to temporarily suspend a participant's activities on the platform, deactivate his or her account in any way, delete his or her content, delete the account or send a warning, in particular, but not limited to, in the following cases:
if there is a breach of these terms and conditions of use of the participation platform, and
if the WEBSITE OWNERS believe that the activity of the participant is harmful to others, to the website or to the WEBSITE OWNERS
The participant is responsible for the content of their contributions and for any damages or claims from third parties that may arise. In the case of providing photographs and images, given that the right to one's own image is recognised in the LO 1/1982 of civil protection of the right to honour, to personal and family privacy and to one's own image, the user may only publish images of public officials or third parties who incidentally participate in a public event. In other cases, the user will have to have the relevant authorisation to carry out the publication.
Under no circumstances shall the WEBSITE OWNERS be responsible for the improper use of the site, the platform or the content shared, nor shall they be liable for the use that a natural person makes of the ideas provided, nor for the suitability of these ideas, nor for the results that derive from them. In the event that the content includes a link to another website, the OWNERS OF THE WEBSITE do not assume any liability for any damages and/or losses due to accessing the contents of this link, nor for the content that may be found on this link. In the event of a dispute of any kind or for any reason whatsoever between the participants in the website or a third party, the WEBSITE OWNERS shall not be liable for any claims, demands or damages of any nature whatsoever that are related in any way to this dispute.
D. Operation of the platform
Participants can access and navigate the coopmmunity.eu platform freely and anonymously. Only when they want to carry out any action involving the creation, support or comment of a proposal or participation in a debate will it be necessary to register beforehand. The registration that will allow participation in the platform by commenting on a section or creating proposals must be done by entering the following data: user name, e-mail, password and acceptance of the terms of use. The chosen public user name and the chosen profile image, if applicable, will be visible to the rest of the users.
Likewise, the platform also allows the possibility of registering entities, groups and/or organisations, and in this case, the following data will be requested: name of the organisation, person in charge, e-mail, telephone, password and acceptance of the conditions of use.
The registered person can interact with the platform through the different functionalities enabled for each of the participation processes (debates, proposals, meetings, ...). The verified person will be able to support the proposals and participate in the prioritisation processes.
E. Conditions for the processing of content provided by users
The present conditions regulate the terms applicable to the content submitted by the users of this platform through the corresponding form (hereinafter, the "content"). The content does not include personal data (except the public name of the user and the profile picture chosen by the user) which are provided at the time of registration and verification, but only includes public content provided by the user (comments, proposals, ...). These conditions apply both to the content initially submitted on the coopmmunity.eu platform and to any content that is subsequently submitted or posted on the WEBSITE OWNERS:
Non-confidentiality: All content sent by the user must be likely to be known by the general public. Therefore, the WEBSITE OWNERS will treat such content as non-confidential information.
Procedure: In the event that the WEBSITE OWNERS are interested in the content sent by the user, they may contact the user to request additional information, without thereby acquiring any commitment with respect to the user. This information shall be of a non-confidential nature, without prejudice to the signing of a confidentiality agreement in the event that the parties consider it necessary to exchange information of a confidential nature. This is without prejudice to the provisions of the section on "Intellectual and industrial property rights".
Publicity or dissemination of the contents submitted: Participants in the coopmmunity.eu platform declare that they are aware of and accept the fact that the information provided may be published on the websites owned by the OWNERS OF THE WEBSITE, as well as through other media that the organisation considers appropriate to publicise this initiative.
Intellectual property: Unless otherwise indicated, the contents protected by intellectual property that the user contributes to this website will be subject to a Creative Commons - Attribution - Share Alike (CC-BY-SA) licence.
Notice and removal procedure: Any person, with reasonable grounds, may request the removal of content that breaches the present legal notice and terms of use. The request can be made by e-mail to hola@coopmmunity.eu. The WEBSITE OWNERS will process these requests and reserves the right to make the appropriate checks or verifications prior to the removal of any content.
